They discussed that it is to recognize the long duration of this interlocal and that over that time horizon the County and the City might not have the same interests going forward as they have different electorates, where the City\\rquote s authorities would end and if they could strengthen the agreement to preserve some of the County decision making when it comes to county-wide services that are being offered while still honoring Bellingham\\rquote s authority over their funding commitment, that the Administration does not want to overcommit the City or bind any future councils from the City of Bellingham into strict decision-making, if it looks different for the small cities and whether they understand what this means coming from the City of Bellingham, that the updated interlocal does not change the situation for the small cities apart from asking them to continue to contribute longer, that the version the Council sees before them was negotiated with Mayor Korthuis (City of Lynden) and that he indicated his support for it, that this will go before the small cities and they will have the question about their continued participation, that the contribution of the small cities (after construction of capital projects) has always been different from that of Bellingham, that contributions from Bellingham are much longer and the use of the jail is much bigger than the smaller cities, if it is appropriate to try to amend the contract if the proposed amendments did not originate from the parties of the agreement, that the budget cap stipulated by the Council is the underlying assumption of the interlocal and that what is presented today is an agreement that achieves what was promised to the County\\rquote s city partners and what the Council has been told in previous conversations, that if there is any misalignment with the guiding principles this is the first time the Administration has heard about it, and that contract negotiations are a function that executive leaders of each jurisdiction in the county hold so the agreement was not reviewed by an advisory board.\\par\r\n\\par\r\nCouncilmembers discussed getting the amendments in a format in which the Council can see them, that they may just be friendly amendments, whether they should consider amendments, why the whole Council has not seen them, that considering them could erode trust with the parties of the agreement, that amendments are not something they typically do with interlocals, and that the interlocal has already been vetted.\\par\r\n\\par\r\nSidhu stated the whole process has been transparent and all the elected people deserve the same transparency. The activist community will always want something different but they are not elected to vote. He stated everyone has been given a chance to discuss this budget and at the last moment it is not fair.\\par\r\n\\par\r\nCouncilmembers discussed why it comes to the Council if they cannot dive into it, that this is the first opportunity the Council has had to discuss the shift to Bellingham City Council having the responsibility if they and the County cannot come to an agreement, that negotiation and design of an interlocal has already happened and that it will have to go back and get approval from everyone else if the Council changes it, and that every day of delay is costing $40,000.\\par\r\n\\par\r\n\\b\\i Galloway moved\\b0\\i0 to hold until she can receive a Word version of the copy to incorporate some amendments for Council's consideration.\\par\r\n\\par\r\nThe motion was seconded by Boyle.\\par\r\n\\par\r\nKimberly Thulin, Prosecuting Attorney's Office, spoke about the maker of the motion specifying where they would hold it to, the Council\\rquote s role in interlocal negotiations, that the item may need to be re-noticed if the Council wants to make material changes to it and they would not be able to approve it today, and what would happen if the interlocal does not receive a Council majority vote.\\par\r\n\\par\r\n\\b\\i Galloway\\b0\\i0 sent the amendments to the rest of the Council and \\b\\i amended\\b0\\i0 her motion to hold until the end of this meeting.\\par\r\n\\par\r\nCouncilmembers discussed the motion.\\par\r\n\\par\r\nThe motion to hold failed by the following vote:\\par\r\n\\b Aye\\b0 : 2 - Galloway and Rienstra \\par\r\n\\b Nay\\b0 : 5 - Boyle, Buchanan, Elenbaas, Scanlon, and Stremler\\par\r\n\\par\r\nLongman answered if there are certain pieces of the Implementation Plan that the City of Bellingham is concerned about and what they anticipate might change as the electorate changes. He stated the City committed to working with the County and to the Implementation Plan and that the intent for the inclusion (of clarity on Bellingham\\rquote s decision-making role) is to recognize that they cannot anticipate what things are going to be like in ten or twenty years from now and that the City and the County may have divergent interest in what they feel this money should be used for. This language is just to have some flexibility and because there is no other mechanism for disagreement on the Implementation Plan.\\par\r\n\\par\r\nBoyle stated she wants to make sure they are safeguarding so that there are two bodies protecting this interest.\\par\r\n\\par\r\nLongman answered who would make the decision if the City does not agree with changes to the Implementation Plan, and stated it is ultimately the decision of the County Council and the City Council whether they adopt that implementation plan. He spoke about future recommendations of the Finance and Facility Advisory Board (FFAB) and that they built in to that committee policy-makers from both the County and City so they will recommend an Implementation Plan that reflects the interests of both organizations. Both councils should adopt a plan but if they cannot, there should be some structure there to provide flexibility for how to deal with that.\\par\r\n\\par\r\nGalloway had staff share the suggested amendments on the screen so councilmembers could walk through them and maybe discuss which seem friendlier or if there is any \\ldblquote low-hanging fruit.\\rdblquote She stated she thinks these proposals are consistent with the original ordinance and historical Council interest and policy guidance, and in some cases add additional clarification language. \\par\r\n\\par\r\nShe read some of the amendments and councilmembers and the speakers discussed that they seem to be reiteration of everything they have done so far policy-wise and that the policy\\rquote s goals have not changed, the suggested amendment (number 8) to restore the tribal seats on the FFAB, that the tribes are asking for government-to-government relations but not asking to be members of committees that advise the County Council, and that they have been invited.\\par\r\n\\par\r\n\\b\\i Elenbaas moved\\b0\\i0 to call the question. \\par\r\n\\par\r\nThe motion was seconded by Stremler.\\par\r\n\\par\r\nKirsten Smith, Clerk of the Council, stated the motion to call the question is not debatable, cannot be amended, and requires a two-thirds majority (5).\\par\r\n\\par\r\nThe motion to call the question failed by the following vote:\\par\r\n\\b Aye\\b0 : 2 - Elenbaas and Stremler\\par\r\n\\b Nay\\b0 : 5 - Buchanan, Galloway, Rienstra, Scanlon, and Boyle\\par\r\n\\par\r\nThulin answered what the Council's role is in voting for the interlocal.\\par\r\n\\par\r\nCouncilmembers and the speakers discussed whether they \\i\\f2 should \\i0\\f0 amend the interlocal even though they have the ability to do so, if there are any aspects of this interlocal that go against the resolution that they passed earlier this year, the opinion that it is the Council\\rquote s role and position to be having these discussions, if any of the suggestions have not already been discussed in the last two years, that the agreement should be succinct and talk about the policies to get this project going, the opinion that the partnership (and trust in it, and the people working on the interlocal) is outweighing most things right now, that the interlocal is already very specific that any money that is not going toward the approved project costs will be going to other Implementation Plan projects (answering to amendment suggestions 2 and 3), where that language is located in the interlocal (part 2, section 3, \\ldblquote Eligible Expenditures And Allocation Of Sales Tax,\\rdblquote subsection B), and that the \\ldblquote Revenue Stabilization Reserve\\rdblquote as noted in Exhibit C (on file) is separate from the General Fund budget stabilization reserve that is proposed for the next biennium. \\cf1\\f2\\par\r\n}\r\n","EventItemActionId":416,"EventItemActionName":"AUTHORIZED","EventItemActionText":"Elenbaas's motion that the Interlocal be AUTHORIZED carried by the following vote:","EventItemPassedFlag":1,"EventItemPassedFlagName":"Pass","EventItemRollCallFlag":0,"EventItemFlagExtra":0,"EventItemTitle":"Request authorization for the County Executive to enter into an interlocal agreement between Whatcom County, the City of Bellingham, the City of Blaine, the City of Everson, the City of Ferndale, the City of Lynden, the City of Nooksack and the City of Sumas to jointly finance a new Whatcom County Justice Facility and Behavioral Care Center","EventItemTally":null,"EventItemAccelaRecordId":null,"EventItemConsent":0,"EventItemMoverId":352,"EventItemMover":"Ben Elenbaas","EventItemSeconderId":412,"EventItemSeconder":"Mark Stremler","EventItemMatterId":23578,"EventItemMatterGuid":"9ED7D9BA-CADA-4BD7-9CE3-D44C4D417695","EventItemMatterFile":"AB2026-783","EventItemMatterName":null,"EventItemMatterType":"Interlocal","EventItemMatterStatus":"Authorized","EventItemMatterAttachments":[]},{"EventItemId":68026,"EventItemGuid":"0CC7CCD5-4C17-4A0A-8B27-3B547C486FC5","EventItemLastModifiedUtc":"2026-10-27T19:21:04.14","EventItemRowVersion":"AAAAAADhx0k=","EventItemEventId":3407,"EventItemAgendaSequence":15,"EventItemMinutesSequence":17,"EventItemAgendaNumber":"10.","EventItemVideo":352942,"EventItemVideoIndex":803,"EventItemVersion":"1","EventItemAgendaNote":null,"EventItemMinutesNote":null,"EventItemActionId":367,"EventItemActionName":"AUTHORIZED BY CONSENT","EventItemActionText":"Galloway moved and Boyle seconded that the Interlocal be AUTHORIZED BY CONSENT. He answered if the $312,688 is for the design of just one culvert and stated it is because it is in the South Fork floodplain and is more complicated than they would think. He answered if it is really increasing the budget as opposed to increasing the scope, and stated it is adding additional budget to the final design. He answered if this also includes Phase 3 and stated his recollection is that the construction support in that phase would be in addition to this at a later date. He answered questions about the amount of water and flooding on the site and stated it is dry the vast majority of the time (with the exception of when the South Fork floods).\\cf1\\f2\\par\r\n}\r\n","EventItemActionId":416,"EventItemActionName":"AUTHORIZED","EventItemActionText":"Galloway's motion that the Contract (FCZDBS) be AUTHORIZED carried by the following
