(Aqua), a private water utility, requested emergency water service after mechanical failures affected both wells serving the Mansions of Prosper development near Custer Road and Bloomdale Road. The development is located outside of the City’s corporate limits and not within the City’s water service area.\nGiven the immediate need to maintain water service, the City established a temporary emergency interconnection. The City Manager and Aqua executed the Emergency Interconnection and Treated Water Supply Agreement on October 13, 2026. The proposed Resolution ratifies and confirms that prior execution.\n\nBACKGROUND INFORMATION: \n\tOn Monday, September 28, 2026, Aqua contacted Public Works after failures of both wells at its North Custer Road Plant reduced water production. Public Works coordinated an emergency connection to deliver treated water from the City’s system while Aqua repairs its wells.\nThe temporary connection uses a City fire hydrant on Bloomdale Road, a City-owned hydrant meter and backflow prevention assembly, and temporary piping to Aqua’s facilities. TCEQ conditionally approved the interconnection on September 30, 2026, for the period needed to restore Aqua’s normal water supply.\nThe relatively small quantity of water needed is not expected to materially affect City water system operations. Service is temporary and interruptible, with a maximum term of 120 days from September 28, 2026, under the executed agreement.\nAqua is solely responsible for operation, treatment, water quality, monitoring, regulatory compliance, and customer delivery within its system after the City’s point of delivery. The City may reduce, suspend, or terminate emergency water service as needed to protect its system and has no continuing obligation to serve.\n\nFINANCIAL SUMMARY: \nAqua will pay the applicable out-of-city water rate equal to 125% of the in-city water rate, based on metered usage.\nAqua must also reimburse 100% of City costs arising from the emergency interconnection and supply, including personnel, operations, equipment, administration, engineering, and legal expenses. No permanent City water service obligation is established.\n\nBOARD OR COMMISSION RECOMMENDATION:\n\tN/A\n\n\n\n","MatterTextRtf":"{\\rtf1\\fbidis\\ansi\\ansicpg1252\\deff0\\deflang1033\\deflangfe1033{\\fonttbl{\\f0\\fswiss\\fprq2\\fcharset0 Arial;}{\\f1\\fswiss\\fprq2\\fcharset0 Aptos;}{\\f2\\froman\\fprq2\\fcharset2 Symbol;}}\n\\viewkind4\\uc1\\pard\\ltrpar\\nowidctlpar\\qj\\b\\f0\\fs24 ..Title\\par\n\\pard\\ltrpar\\sa120\\sl276\\slmult1\\qj\\kerning2\\b0 Consider/Discuss/Act on a Resolution Ratifying and Confirming the City Manager\\rquote s Execution of a Temporary Emergency Interconnection and Treated Water Supply Agreement with Aqua Texas, Inc.\\par\n\\pard\\ltrpar\\nowidctlpar\\qj\\kerning0\\b ..Summary\\par\n\\par\n\\pard\\ltrpar\\sl252\\slmult1\\tx2160\\tqc\\tx4320\\tqr\\tx8640 COUNCIL GOAL:\\tab\\kerning2 Operational Excellence\\b0\\f1\\par\n\\tab\\f0 (2.1: Balance available resources to accommodate the growth and\\par\n\\tab maintenance needs of the City)\\par\n\\pard\\ltrpar\\nowidctlpar\\tx2160\\kerning0\\b\\par\nMEETING DATE:\\tab\\b0 November 3, 2026\\par\n\\b\\par\nDEPARTMENT:\\b0 \\tab Public Works Department / Water Utilities Division\\b\\par\n\\par\nCONTACT:\\b0 \\tab Ryan Gillingham, PE - Director of Public Works\\par\n\\tab Michael George - Assistant Director of Public Works\\par\n\\pard\\ltrpar\\nowidctlpar\\tx2160\\tx2880\\par\n\\pard\\ltrpar\\nowidctlpar\\tx2160\\b\\par\n\\pard\\ltrpar\\nowidctlpar\\qj RECOMMENDED CITY COUNCIL ACTION:\\tab\\par\n\\pard\\ltrpar\\nowidctlpar\\fi-360\\li720\\tx720\\b0\\f2\\'b7\\tab\\f0 Approval of the Resolution\\b\\par\n\\pard\\ltrpar\\nowidctlpar\\li360\\par\n\\pard\\ltrpar\\nowidctlpar\\qj ITEM SUMMARY: \\par\n\\pard\\ltrpar\\fi-360\\li720\\sa120\\qj\\tx720\\tqc\\tx4320\\tqr\\tx8640\\kerning2\\b0\\f2\\'b7\\tab\\f0 On September 28, 2026, Aqua Texas, Inc.
