The buffer for Melody preserve is called out in Resolution 25-R-107 OTOW Bay Laurel PUD (conditions 6a and 6b, attached).\\par\r\n\\par\r\n\\pard\\qj\\f1\\fs24 LDC 6.8.6.K(5) \\b E-Type buffer\\b0  requirement is 5-feet wide with trees and shrubs; a 6-foot opaque fence may be used in lieu of a vegetative buffer between single-family and single-family uses. The PUD approval modified the E-Type buffer to 20-feet instead of 5-feet.  Today's request will result in a 6-feet tall vinyl fence in a 20 feet wide buffer space with no trees or shrubs.\\par\r\n\\par\r\nLDC 6.8.6.K(1) \\b A-Type buffer\\b0  requirement is 30-feet wide with trees and shrubs. The PUD approved modified A-Type was a reduction from 30-feet to 20-feet wide. Today's request will result in a 6-feet tall vinyl fence in a 20 feet wide buffer space with no trees or shrubs.\\par\r\n\\pard\\par\r\nThe DRC voted to deny the waiver request as it was shown in the buffer details included when the PUD was approved.
