Although DART had approved the original construction plans on February 23, 2018, the revised federal requirements necessitated additional safety analyses and design modifications before work could continue within DART right-of-way.\n\nAs a result, after all work outside the DART right-of-way had been completed, construction activities were suspended on March 17, 2023. Upon completion of the PHA study, required design revisions, and DART's review, DART issued a No-Objection Letter on May 16, 2025, allowing the resumption of construction activities within its right-of-way.\n\n\n\nDuring the extended construction suspension period, inflation and escalation in material and labor costs significantly increased the cost of completing the remaining work such that some remaining work items cannot be completed at the original contract unit bid price. Consequently, adjustments to the unit prices of these work items to reflect current prices are necessary.\n\nThe CBD Fair Park Link project cannot be completed until the DART crossing improvements are constructed and operational. Until this work is complete, pedestrians and bicyclists are unable to safely cross the DART tracks at Elm Street, leaving an incomplete transportation corridor and preventing the project from achieving its intended safety improvements. Completion of the CBD Fair Park Link project is necessary to provide a safe, accessible, and Americans with Disabilities Act (ADA)-compliant corridor consistent with the City's Vision Zero goals.\n\nThis action will authorize Change Order No. 6 to the construction services contract with DDM Construction Corporation to (1) provide additional work items needed to complete the construction of the CBD Fair Park Link from Hall Street to Main Street; and (2) extend the contract term by two hundred forty calendar days, from May 5, 2027 to December 31, 2027, in an amount not to exceed $2,214,096.23, increasing the contract amount from $5,937,904.87 to $8,152,001.10.\n\nESTIMATED SCHEDULE OF PROJECT\n\nBegan Construction March 2022\nComplete Construction December 2027\n\nPRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)\n\nOn September 22, 2021, the City Council authorized a construction services contract with DDM Construction Corporation for the construction of CBD Fair Park Link from Hall Street to Main Street by Resolution No. 21-1522. \n\nFISCAL INFORMATION \n\nFund\n\tFY 2027\n\tFY 2028\n\tFuture Years\n\t\n\tDART Six-Year General Mobility Program Fund\n\t$2,202,897.23\n\t$0.00\n\t$0.00\n\t\n\tWater Capital Improvement F Fund\n\t$ 11,199.00\n\t$0.00\n\t$0.00\n\t\n\tTotal\n\t$2,214,096.23\n\t$0.00\n\t$0.00\n\t\n\t\nConstruction Contract\t$5,841,110.00\nChange Order No. 1\t$ 84,549.07\nChange Order No. 2\t$ 0.00\nChange Order No. 3\t$ 9,005.80\nChange Order No. 4\t$ 3,240.00\nChange Order No. 5\t$ 0.00\nChange Order No. 6 (this action)\t$2,214,096.23\n\nTotal\t$8,152,001.10\n\nBUSINESS PARTICIPATION\n\nPrime \n\tStatus\n\tWorkforce %\n\t\n\tDDM Construction Corporation\n\tNon-local\t7.50%\t\t\n\nOWNER/EXECUTIVE\n\nDDM Construction Corporation\n4006 Belt Line Road, Suite 230\nAddison, Texas 75001\n\nZackery Markwardt, President\n\nMAP\n\nAttached\n","MatterTextRtf":"{\\rtf1\\fbidis\\ansi\\ansicpg1252\\deff0\\deflang1033\\deflangfe1033{\\fonttbl{\\f0\\fswiss\\fprq2\\fcharset0 Arial;}}\n{\\colortbl ;\\red0\\green112\\blue192;\\red255\\green255\\blue255;\\red0\\green0\\blue0;}\n\\viewkind4\\uc1\\pard\\ltrpar\\sa160\\sl252\\slmult1\\tx3060\\cf1\\b\\strike\\f0\\fs24 PILLAR:\\tab\\cf0\\b0 Sustainable\\par\n\\cf1\\b AGENDA DATE:\\tab\\cf0\\b0 November 10, 2026\\par\n\\cf1\\b COUNCIL DISTRICT(S):\\tab\\cf0\\b0 2\\b\\par\n\\cf1 DEPARTMENT:\\tab\\cf0\\b0 Department of Transportation and Public Works\\par\n\\cf1\\b PRIORITY:\\tab\\cf0\\b0 Infrastructure\\par\n\\pard\\ltrpar\\sa160\\sl252\\slmult1\\qj\\strike0 ______________________________________________________________________\\par\n\\pard\\ltrpar\\qj\\ul\\b\\strike SUBJECT\\par\n\\ulnone\\b0\\strike0\\par\n\\cf2\\fs16 ..Title\\par\n\\cf0\\strike\\fs24 Authorize an increase in the construction services contract with DDM Construction Corporation to \\b (1)\\b0 provide additional work items needed to complete the construction of the CBD Fair Park Link from Hall Street to Main Street; and \\b (2) \\b0 extend the contract term by two hundred forty calendar days, from May 5, 2027 to December 31, 2027 - Not to exceed $2,214,096.23, from $5,937,904.87 to $8,152,001.10 - Financing: DART Six-Year General Mobility Program Fund ($2,202,897.23) and Water Capital Improvement F Fund ($11,199.00)\\par\n\\par\n\\b *In alignment with Infrastructure Management Plan.\\par\n\\strike0\\par\n\\cf2\\b0\\fs16 ..Body\\par\n\\cf0\\ul\\b\\strike\\fs24 BACKGROUND\\par\n\\ulnone\\b0\\par\nOn September 22, 2021, the City Council authorized a construction services contract with DDM Construction Corporation for the construction of CBD Fair Park Link from Hall Street to Main Street by Resolution No. 21-1522. \\par\n\\par\nOn June 16, 2022, Dallas Area Rapid Transit (DART) notified the City that construction activities within the DART railroad crossing could not proceed until a Preliminary Hazard Analysis (PHA) was completed and approved in accordance with updated federal railroad safety requirements.
