NW. See red area in graphic below for location of Vacation.\r\n\r\n(See map on write-up)\r\n\r\nDue to this vacation application coming in prior to the current version of the IDO, it falls under the former standards of procedure which had Council has the decision-making body. Under the current IDO, the decision-making power will be through the DHO and if appealed, it will come to Council after LUHO review. \r\n\r\nPursuant to Section 14-16-6-6(M)(1)(b) of the former IDO, the DHO is the recommending body to the City Council on this request because the Vacation is more than 500 square feet and the entire width of a street. At the April 8th, 2026 public meeting, the DHO recommended approval of the request to the City Council of the proposed vacation. \r\n\r\nA minor preliminary/final plat application for DHO review and approval must be submitted within one year of the City Council’s approval of the Vacation. The platting will not be approved by the DHO unless the Vacation has been approved by City Council. The preliminary plat must be completed within a year’s time or the vacation will expire. \r\n\r\nIn its current state, 62nd street is an unimproved dead end road, concluding at Coors Blvd, a State owned road.  Most of the unimproved road will have to be constructed as development occurs along the way.  The Vacated area will end up being used as an HOA owned lot that will contain the storm sewer outfall, as it was determined the only place where it could fit without removing a housing unit.  \r\n\r\nIf this Vacation is approved, the Real Property Division will begin outreach to the applicable property owners to initiate the purchase process. In the case of this vacation, all adjacent properties are owned by the Bernalillo County Metropolitan Courthouse. The property owner will be required to replat the properties to show the newly acquired vacated ROW and if any abutting or adjacent parcels are out of conformance, they will be required to come into conformance with the current IDO standards. The vacation will be voided if the ROW isn’t purchased in full and the replat actions don’t occur within one year of the vacation being approved.\r\n\r\nAnalysis: The 2017 Comprehensive Plan outlines the following policy related to vacations of right-of-way: Policy 6.2.1.c) Improve connectivity to provide route options and decrease distance to services for all users, particularly vulnerable populations, by reinforcing the street grid, providing pedestrian access points through subdivisions and discouraging right-of-way vacations, etc. \r\n\r\nWhile this vacation does break up the street grid, a street like Coors Blvd is meant to have less ingress and egress points due to the high traffic level and the neighborhood is already served by Daytona Rd. and Cloudcroft Rd. \r\n\r\nFiscal Impact: The purchase price will be established through the Real Property Division purchasing process. \r\n\r\nKey Dates: The vacation will become final once a minor plat is submitted and the purchase of the land has gone through the Real Property Division.","MatterEXText2":"Matthew Cox","MatterEXText3":null,"MatterEXText4":null,"MatterEXText5":null,"MatterEXText6":null,"MatterEXText7":null,"MatterEXText8":null,"MatterEXText9":null,"MatterEXText10":null,"MatterEXText11":null,"MatterEXDate1":null,"MatterEXDate2":null,"MatterEXDate3":null,"MatterEXDate4":null,"MatterEXDate5":null,"MatterEXDate6":null,"MatterEXDate7":null,"MatterEXDate8":null,"MatterEXDate9":null,"MatterEXDate10":null,"MatterAgiloftId":0,"MatterReference":"27","MatterRestrictViewViaWeb":false,"MatterReports":[]}
