This bill would create a new article 23 of Chapter 9 to achieve these goals and would affect a variety of different city departments, including ACS, APD, and Code Enforcement.\r\n\r\nAnalysis: This bill allows the City to designate contiguous areas as ESSZ and for these areas to receive enhanced municipal services. This bill details how an ESSZ shall be designated by meeting certain criteria, including that the ESSZ resides in a commercial, high crime, and/or distressed and underserved area. Under this bill, an ESSZ shall be designated by the Mayor by submission of an Executive Communication for approval by the City Council.\r\n\r\nFor the purposes of this bill, enhanced municipal services include:\r\n•\thigh-frequency sidewalk or plaza cleaning services;\r\n•\thigh-frequency street cleaning and maintenance;\r\n•\tenhanced trash collection services;\r\n•\tpriority graffiti abatement;\r\n•\tincreased proactive response frequency of ACS;\r\n•\tincreased APD patrols;\r\n•\textended service/operational City department hours;\r\n•\tprioritized enforcement of existing pedestrian laws;\r\n•\tprioritized response to encampments;\r\n•\ttargeted capital improvements on the public right-of-way;\r\n•\tincreased code enforcement presence; or \r\n•\tother services as may be appropriate. \r\n\r\nThis bill also includes penalties for anyone to sit, sleep, lie, or camp on any public street, road, bike path, alley, or on any sidewalk within an ESSZ in a manner that impedes passage within the meaning of the ADA. \r\n\r\nThe designation period for an ESSZ would be limited to two years from the date the enhanced services commence. The Mayor may propose redesignation via Executive Communication subject to approval by the City Council. This bill also includes requirements for annual progress reports to be submitted by the Mayor to the Council. The Mayor would also be required to provide notice to the public by maintaining a public facing map and list of all ESSZ locations and respective enhanced services and delineating such locations using signs, curb paint, or other visual notification measures.\r\n \r\nLastly, this bill imposes the maximum fine or penalty as provided in ROA 1994, section 1-1-99 for any violation of City ordinance within an ESSZ.\t\r\n\r\nFiscal Impact: This bill’s prospective fiscal impact is likely large, given (1) the scope of departments involved, (2) the manpower required to meet the enlargement of services provided by the city, and (3) the resources expended to maintain ESSZs to the requisite cleanliness standards. \r\n\r\nKey Dates: The only key date relevant to this bill is its effective date: “[t]his Ordinance takes effect five days after publication by title and general summary.”\r\n\r\nComments: This matter came before FGO on April 13, 2026.
