This Ordinance is an amendment to the existing ShortTerm Rental (STR) code, Section 13-19-6.  This amendment creates a 330 ft. separation requirement for STRs from each other. For scale, 330 ft. is approximately the size of a typical city block in the downtown area. For example, if a newly applied for STR is within 330 ft. of another, it will not be permitted, unless it meets some of the provided exceptions:\r\n•\tIf the STR is a single room in an owner-occupied dwelling unit.\r\no\tFor example, if you decide to rent out a guest room in your residence, but live in the house still, this amendment will not affect your STR status.\r\n•\tIf the STR is an ADU/casita/mother in-law suite, it is permissive and does not require a 330 ft. separation, if the principal structure is owner occupied.\r\n\r\nAlthough this amendment to the ordinance limits where STRs are permitted within the provided boundary, language has been included that protects existing STRs, until their permit expires and they decide not to renew. A short-term rental operator (STRO) will get notified approximately 2 months prior to their permit expiring, letting them know that they need to renew their permit.\r\n\r\nAnalysis: The intent of the sponsors of this bill are to lessen the impact of STRs on housing stock around some of the more touristic areas of town, such as Old Town, Downtown, sport stadiums and Nob Hill.  Councilors have heard concerns from the public about how STRs can limit available housing, increase housing and rental prices, remove passive surveillance from neighborhoods and can burden neighbors with noise or other disruptive behaviors, based on the attentiveness of the STRO.  \r\nIn District 2, the boundary specifically looks to incorporate the Pockets of Poverty in Central Albuquerque, where the Housing and Neighborhood Economic Development Committee has been asking for action around STRs in a number of engagement efforts, most recently being the Rail Trail’s Advancing Inclusive Growth Through Albuquerque’s Rail Trail.  \r\n\r\nFiscal Impact: Currently, an STR registration is initially $120.00 and $90.00 for every renewal.  This bill may reduce the number of new registration applications to the Planning Department, but the aggregate total is unknown.\r\n\r\nKey Dates: Takes effect five (5) days after publication. \r\n\r\nComments: As of August 26th, there were 825 permitted STRs within the City of Albuquerque. The Planning Department enforces STRs that aren’t permitted through a complaint-based system, but they also use a third-party monitoring system that will notify them of any potential violations. The map below shows all of the registered STRs in Albuquerque, as of August 26th and the boundary shown in Exhibit A.\r\n\r\n[See map on writeup]","MatterEXText2":"Matthew Cox","MatterEXText3":null,"MatterEXText4":null,"MatterEXText5":null,"MatterEXText6":null,"MatterEXText7":null,"MatterEXText8":null,"MatterEXText9":null,"MatterEXText10":null,"MatterEXText11":null,"MatterEXDate1":null,"MatterEXDate2":null,"MatterEXDate3":null,"MatterEXDate4":null,"MatterEXDate5":null,"MatterEXDate6":null,"MatterEXDate7":null,"MatterEXDate8":null,"MatterEXDate9":null,"MatterEXDate10":null,"MatterAgiloftId":0,"MatterReference":"26","MatterRestrictViewViaWeb":false,"MatterReports":[]}
